Terms of Service / General Terms and Conditions (AGB)
Last updated: 20 October 2026
1. Scope and provider
These Terms of Service ("Terms") govern all contracts concluded through the online shop at hairproshop.eu between:
Hair Pro Shop, sole proprietor Andrii Chernyshuk, Putzbrunner Straße 10, 85521 Ottobrunn, Germany. Email: hairproeu@gmail.com. Phone: +49 175 6296979. VAT ID: DE354396739. (the "Seller", "we", "us")
and the customer (the "Customer", "you").
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). An entrepreneur is a natural or legal person acting in the exercise of their trade, business or profession (§ 14 BGB).
These Terms apply exclusively. Deviating, conflicting or supplementary terms of the Customer do not become part of the contract unless we have expressly agreed to them in writing.
2. Conclusion of contract
The presentation of products in our shop does not constitute a legally binding offer, but an invitation to place an order.
By clicking the order button ("Buy now" / "Pay now") you submit a binding offer to purchase the goods in your cart. We confirm receipt of your order by an automatic email; this confirmation of receipt does not yet constitute acceptance of your offer.
The contract is concluded when we send you a separate order confirmation or a dispatch notification, or when we deliver the goods, whichever occurs first.
Before submitting your order you can review and correct your entries at any time using the browser and the correction functions of the ordering process. The contract language is English. We store the contract text and send you the order data by email; you can also access it in your customer account where one exists.
3. Prices and shipping costs
All prices are final prices in euro (EUR) and include the statutory value added tax applicable to your delivery country, unless stated otherwise at checkout.
Shipping costs are shown separately before you complete your order and are listed in our Shipping Policy.
For deliveries outside the European Union, customs duties, import turnover tax and handling fees may be charged by the destination country. These are payable by the Customer and are not included in our prices. Please inform yourself about applicable import rules before ordering.
Deliveries within the European Union to consumers are invoiced under the One-Stop-Shop (OSS) scheme with the VAT rate of the destination country.
4. Payment
Payment methods available to you are shown at checkout. Payment is due immediately on conclusion of the contract unless agreed otherwise.
We reserve the right to exclude individual payment methods in specific cases, for example where a credit check returns a negative result.
If the Customer is in default of payment, we are entitled to charge default interest at the statutory rate. Against entrepreneurs, our right to claim further damages caused by delay remains unaffected.
5. Delivery and transfer of risk
We deliver to the destinations listed in our Shipping Policy. Delivery times are stated there and are estimates unless we have expressly agreed a binding delivery date.
Orders are dispatched within 1–3 business days of receipt of payment. Products in our US warehouse are dispatched domestically within the United States.
For consumers, the risk of accidental loss or deterioration passes to the Customer upon handover of the goods. For entrepreneurs, the risk passes upon handover of the goods to the carrier.
If a product is unavailable after conclusion of the contract through no fault of our own, we will inform you without delay and refund any payment already made immediately.
Partial deliveries are permitted where reasonable for the Customer and do not incur additional shipping costs.
6. Retention of title
The goods remain our property until full payment of the purchase price has been received. Against entrepreneurs, we retain title until all claims arising from the ongoing business relationship have been settled in full.
7. Right of withdrawal for consumers
Consumers have a statutory right of withdrawal of 14 days. The full withdrawal instruction, the statutory exceptions for sealed cosmetic and hygiene products, and the model withdrawal form are set out in our Refund and Return Policy, which forms an integral part of these Terms.
8. Warranty and liability for defects
Statutory warranty rights apply. For consumers the limitation period for claims for defects is two years from delivery of the goods. For entrepreneurs the limitation period is one year from delivery; the statutory periods for claims in rem, fraudulent concealment and recourse claims remain unaffected.
Entrepreneurs must inspect the goods on receipt and notify us of obvious defects without delay, and of hidden defects immediately upon discovery (§ 377 HGB).
Minor deviations in colour, shade or consistency that are customary for cosmetic products and do not impair their function do not constitute a defect.
9. Limitation of liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee.
In cases of slight negligence we are liable only for breach of a material contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment the contracting party regularly relies). In such cases our liability is limited to the foreseeable damage typical for this type of contract.
Any further liability is excluded.
10. Proper use of products
Our products — keratin bonds, gels, adhesives, activators and removers — are intended for professional use in hair extension work. They must be used in accordance with the instructions supplied and the applicable safety data sheets.
The Customer is responsible for carrying out a patch test where recommended, for using suitable protective equipment, and for complying with national rules governing the use of such products. We accept no liability for damage resulting from improper use, from use contrary to the instructions, or from use by persons without the necessary training.
The Customer is responsible for ensuring that the import and use of the goods is permitted in their country.
11. Resale and distribution
Purchase of our goods does not grant any right to use our trade marks, product images or brand names for independent commercial purposes. Resale under a different brand, repackaging, or listing our products on third-party marketplaces requires our prior written consent.
12. Vouchers and promotions
Promotional vouchers are valid only for the period stated and only for one order. They cannot be combined with other promotions unless expressly stated, cannot be paid out in cash and do not bear interest. If goods are returned, the voucher value is not refunded.
13. Data protection
We process personal data in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR).
14. Online dispute resolution and consumer arbitration
The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
15. Applicable law and place of jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers habitually resident in the European Union, this choice of law does not deprive them of the protection afforded by the mandatory provisions of the law of their country of residence.
If the Customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is our registered office.
16. Final provisions
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions is unaffected. The invalid provision is replaced by the applicable statutory provision.
Amendments to these Terms apply only to contracts concluded after the amendment takes effect.
